I heard about this case and it irritated me at the time I read it. It's still irritating to me now. I have always been an advocate of personal responsibility, so I totally think Mr. Kennedy should have done his due diligence and updated everything accordingly. However, it was officially ruled within a divorce decree and his intent was very clear that the ex-wife NOT receive the benefits. The fact that the Supreme Court ruled against this is extremely frustrating. They are going against his wishes.

Again, not that I don't understand their decision and I realize that ruling the other way would have set a precedent that would probably come back to bite them in the butt; however, I just think that the intention in this case was quite clear and if it had been ruled and written within the divorce decree, that should be enough whether he filed it or not. A court had already ruled on this once, so it seems ridiculous that the Supreme Court went against it.

But, moral of the story...update the beneficiaries! Great reminder!

It's a great point, the last thing you want to have to worry about in a situation like that is losing the financial protection that such accounts could provide.
